Privacy Notice (KVKK)

1. Data controller

This notice has been prepared by Çağlar Umut TOSUN – Yeniçağ Reklam ("Yeniçağ Reklam") in its capacity as data controller, pursuant to Article 10 of Turkish Law No. 6698 on the Protection of Personal Data ("KVKK").

2. Which personal data do we process?

• Contact form: full name, telephone, e-mail, subject, message and, optionally, any photograph or document you attach.
• Chat window and "Call me back": name (optional), telephone, message and the address of the page the message was sent from.
• Quotation process: company/person name, contact person, telephone, e-mail, the content of the quotation and the date and time you approved it.
• Transaction security: the IP address, date and time, and browser information kept in our server logs when you visit our site.

3. For which purposes do we process your personal data?

• To respond to your request, to carry out a survey, to prepare a design and a price quotation,
• To get back to you by telephone, WhatsApp, SMS or e-mail and to confirm that your message and your quotation approval have been received,
• To run quotation and contract processes and to plan production and installation,
• To fulfil our invoicing and statutory retention obligations,
• To keep our site secure and to prevent misuse.

Your personal data are not used for marketing or advertising purposes; no campaign SMS or e-mail is sent to you.

4. Legal grounds and method of collection

Your data are collected electronically and by automated means through the forms on our site, the chat window and the quotation page. Under Article 5/2 of the KVKK, the legal grounds for processing are:

• (c) that it is directly related to the conclusion or performance of a contract (quotation request, quotation and order process),
• (ç) that it is necessary for the data controller to fulfil a legal obligation (tax and commercial legislation),
• (f) our legitimate interest, provided that it does not harm your fundamental rights and freedoms (responding to your request, site security).

5. To whom do we transfer your personal data?

Your data are shared only for the purposes above and only to the extent necessary, with the following service providers:

• Hosting: our site and its data are hosted on the Germany-based servers of Hetzner Online GmbH. This transfer is carried out in accordance with the conditions for transfer abroad set out in Article 9 of the KVKK.
• E-mail: notification and confirmation e-mails are sent through the Natro (Türkiye) infrastructure.
• SMS: notification and confirmation text messages are sent through NetGSM (Türkiye).
• WhatsApp: if you choose to continue the conversation over WhatsApp, your message is transmitted to WhatsApp (Meta) by you.
• Advertising measurement: if you give your consent on the cookie banner, Google (Google Ireland Ltd. / Google LLC) is informed whether visitors arriving from Google ads went on to contact us. This transfer is based on your explicit consent and contains no message content, name or telephone number; you may withdraw your consent through the "Cookie preferences" link.
• Authorised public institutions and bodies: where legally required.

6. Retention period

• Quotation requests and messages: 2 years from the conclusion of the request,
• Quotation and order records: 10 years, as required by the Turkish Commercial Code and tax legislation,
• Server security logs: 1 year at most.

Once the period expires, your data are deleted, destroyed or anonymised.

7. Your rights under Article 11 of the KVKK

By applying to Yeniçağ Reklam, you have the right to:

• Learn whether your personal data are being processed and, if so, request information about it,
• Learn the purpose of the processing and whether the data are used in accordance with that purpose,
• Know the third parties to whom the data are transferred, in Türkiye or abroad,
• Request correction if the data are incomplete or incorrect,
• Request erasure or destruction within the framework of Article 7 of the KVKK,
• Request that correction and erasure operations be notified to the third parties to whom the data were transferred,
• Object to a result against you arising from analysis carried out solely by automated systems,
• Claim compensation if you suffer loss as a result of unlawful processing.

8. Applications

You may submit your requests, together with information verifying your identity, by e-mail to info@yenicagreklam.com or in writing to Ankara. Your application will be concluded free of charge within 30 days at the latest.
